Home Plan Contract
Terms
of Contract:
Timothy K. Bose agrees to provide to the client a set of blueprints per the
specifications listed on the Home Plan Spec Sheet.
The client agrees to pay
Timothy K. Bose the amount of $0.40 per square foot
based upon the Total Square Footage listed on the Floor Plan (Sheet A-1)
at the completion of the plans. Any
other arrangements must be made prior to starting of the plans. Included in this
price are (3) three sets of plans to be used by the client for building (1) one
home.
Timothy K. Bose will include in
the price as many changes as are necessary to satisfy the client to the original
Floor Plan only. Should the client
deviate from the original Floor Plan, such as changing a single story home to a
two-story home, or rearranging the basic layout, an hourly rate of $75 will be
assessed to that point and then
Timothy K. Bose will start on the new plan at the
rate of $0.40 per square foot. Once
the original Floor Plan is agreed upon, any changes to the Floor Plan thereafter
shall be charged to the client at an hourly rate of $75 plus the cost of
supplies such as paper and ink.
Should the client wish to purchase
the Architectural Grade Plans, a charge will be assessed in addition to the rate
of $0.40 per square foot. Due to the complexity and possible variations, this
charge will have to be quoted and agreed upon prior to starting the plans.
Timothy K. Bose reserves the copyright
to the plans and is free to market them in any way he chooses.
The client is not free to make copies of the plans without consent from
Timothy K. Bose.
Timothy K. Bose strives
to complete all drawings in a timely manner, however this is not always
possible. Therefore,
Timothy K. Bose
will not be held liable for any delays in schedules.
Termination of Contract:
A deposit of $200.00 is required to start the plans.
The contract shall be considered fulfilled upon receipt of the final payment. Should the
client wish to terminate this contract prior to completion of the plans, the
client agrees to the following schedule:
1. There will be no charge to the client if contract is terminated before the Floor Plan has been started, unless a site visit has taken place. Then the only charge will be for the site visit.
2.
Should the client terminate the contract after the Floor Plan
has been started, a charge $0.10 per square foot will be assessed.
3. Should the client terminate the contract after the Floor Plan has been finished, a charge $0.20 per square foot will be assessed.
4.
Should the client terminate the contract after the Exterior
Elevations have been started, a charge $0.30 per square foot will be assessed.
5. Should the client terminate the contract after the Detail Plans (such as the Kitchen Plan, Electrical Plan, Dimensional Plan or Foundation Plan) have been started, the full charge $0.40 per square foot will be assessed.
The $200.00 deposit will apply towards any amounts due. Any difference between the deposit and the amount due will be refunded by check to the client within 14 days of cancellation.
Errors:
Timothy K. Bose shall be liable only for errors on the drawings themselves, and not
for any building materials or labor costs associated with any such errors.
Timothy K. Bose will correct any such errors on the drawings and provide a single
revised set at our expense.
Timothy K. Bose also agrees to consult with the contractor on any questions that arise
concerning the plans.
Timothy K. Bose
agrees to visit the site to clarify any discrepancies in the plans.
However, should the error be found not to be caused by
Timothy K. Bose, then
the client agrees to pay
Timothy K. Bose at the hourly rate of $75 for any time
devoted to the problem.
Non-payment:
It is the responsibility of the client to pay for the services of
Timothy K. Bose.
Should a client be allowed to pay on terms other than upon receipt of the
plans, and then fail to pay (whether or not the plans are actually picked up
by the client),
Timothy K. Bose will file a claim in Vigo County Circuit Court.
Timothy K. Bose will file a claim in the amount of the cost of the full set
of plans (regardless of the progress of the plans), plus the cost of the
filing fee, plus an additional (6) six hours at the rate of $75 per hour for
court time, plus interest of 5% per month from the Invoice Date.
By signing below, the client agrees
to all of the above terms and conditions.
